Work Health and Safety (Public Notification of Indexed Penalty Amounts) Notifiable Instrument 2026

This instrument applies to individuals, persons conducting businesses or undertakings, their officers, and bodies corporate regulated under the Work Health and Safety Act 2011. Based on the Consumer Price Index number for the March quarter of 2026, it publishes the indexed and rounded monetary penalty amounts calculated under Schedule 4 to that Act. Maximum penalties for category 1 to 3 offences apply according to the type of offender. It also specifies the amounts for tiers A to I and tiers 1 to 4 of WHS civil penalty provisions for individuals and bodies corporate. Regulators must apply the amounts set out in the Schedule when administering the relevant penalties.
