Rules and Benchmark Provisions on Discretion in Ecological and Environmental Administrative Penalties of Yunnan Province (2026 Edition)

This document applies to ecological and environmental authorities at all levels in Yunnan Province when exercising discretion in administrative penalties, as well as enterprises, public institutions, other business operators and individuals involved in ecological and environmental violations. It establishes rules on penalty discretion and individualized benchmark tables covering ecological and environmental monitoring, environmental impact assessment, pollutant discharge permits, pollution-control facilities, pollutant discharges, drinking-water source protection, tailings pollution prevention and control, and soil and groundwater pollution prevention and control. Enforcement authorities shall determine penalty ranges based on factors including the facts of the violation, duration, pollutant category, environmental sensitivity, harmful consequences and rectification, and shall lawfully order correction, impose fines and take corresponding administrative measures.
