Abstract

Applicable to the exercise of discretion in ecological and environmental administrative penalties in Zhejiang Province. It specifies mitigating penalty items and maximum mitigation ranges for circumstances such as voluntary rectification and elimination of harm, completion of ecological and environmental restoration and compensation, voluntary disclosure of undiscovered violations, and meritorious cooperation with investigations. It provides for lenient penalties in cases including legal-study credits, restoration and compensation, voluntary disclosure, cooperation with investigations, cessation of violations, and coercion; and aggravated penalties for malicious environmental harm, refusal to rectify, repeated violations, and serious consequences. Cumulative mitigation may not exceed 50%, while lenient or aggravated fine adjustments generally may not exceed 20% of the statutory fine range. It also establishes discretionary scores for transfers of industrial solid waste without electronic transfer manifests based on quantity, destination, duration, and number of violations.
