Abstract

The draft applies to relevant ships navigating in waters under the jurisdiction of the People's Republic of China and to responsible parties such as their operators and owners. It proposes to adjust the minimum amounts of civil liability insurance for ship oil pollution damage, or other financial security, for ships carrying non-persistent oil substances and ships of 1,000 gross tonnage or above carrying non-oil substances, with amounts calculated by gross-tonnage brackets. Amounts for relevant ships below 300 gross tonnage and ships engaged in coastal operations would be calculated under relevant national provisions. The draft also proposes to eliminate the difference between liability limits for coastal transport ships and internationally navigating ships, and to adjust the categories of insurance or financial security certificates for which Chinese-flag ships must apply.
