Measures of Yunnan Province for the Government Reserve and Transfer of Pollutant Discharge Rights (Trial)

These Measures apply to government reserve, transfer and administration of pollutant discharge rights within Yunnan Province. Provincial and municipal ecology and environment authorities shall establish a reserve adjustment system and designate reserve institutions, while finance and tax authorities shall respectively oversee revenue management and collection. Discharge rights may be recovered without compensation in cases including bankruptcy or shutdown, unused surplus rights, reductions upon verification, and projects not commenced; rights acquired for consideration may be purchased into reserve under budgeted transactions. Major projects and small-emission projects may acquire government-reserved rights through negotiated transfer as prescribed, while other newly required rights shall in principle be obtained through public bidding. Reserve institutions shall maintain ledgers, report information and disclose relevant records; transfer revenue shall be remitted in full to the treasury and used in an integrated manner for pollution prevention and control and related purposes.
